Question

I would like to know where to go for information on Protective Orders in TX. What are the requirements? How long does it take. Will it take care of threats, harrassing and stalking?

My response:

If you are in immediate fear for your life, safety, property, freedom, or any other personal liberties, you are entitled to a Restraining Order. You should go to your nearest criminal courts building, and see the clerk at the filing window. She / he will give you all necessary papers to file for a Temporary Restraining Order. When you fill in the papers, YOU MUST BE EXTREMELY GRAPHIC IN YOUR DESCRIPTIONS OF WHAT IS HAPPENING, AND YOUR FEARS. You will then be issued a court date for a hearing to determine whether the Orders should remain in effect. In the meantime, you'll pay to have the papers served on the offending party, with Notice of the court hearing. You and the other party will testify.

Of course, all this depends upon how law abiding the other person is, and whether he / she will abide by the Temporary Orders while you're waiting for your hearing date.

If the other person fails to abide, then you will have all of your papers to show the police and have that person hauled to jail.
