Does a person have to be employed, in order to receive a tax return? My ex says he doesn't work, so he can't pay....but, I have received his tax returns two years in a row with no other child support all year long. I keep thinking that he must be getting paid under the table or something. What do you think? Any suggestions?

A couple of questions: 1. Is your ex disabled? 2. Is he remarried and does he have children from this new marriage that live with him? I will try to check for your responses later today, and from your answers, I hopefully will be able to assist you better.

Also, supposedly his wages are supposed to be garnished. One of his friends told me (today, in fact) that he works for a temporary service, so he works at different places all the time. Would it be hard to garnish the wages on that type of work? Is that illegal? Help!

Usually when you work for a temporary service, they find the work for you and the company pays the temp service and your check would then come from the temp service. So even though his work is not steady, when he does get a check, the temp service can be notified that his check is to be garnished for child support. If you know the name of this service, call child support service and let them put a wage assignment on his check. But be prepared he may change jobs or just refuse to work. He can be held in contempt and thrown in jail for arrearages. If you take him to court and the judge thinks he is not trying to work to spite you, they sometimes the judge will make the dead beat serve time. Then see if he'd rather be in jail or work. Good Luck and God Bless. Keep me posted!
