re:Suing the mother

The child is 12 and my husband was never married to the mother. He left her 5 yrs ago. He had earlier signed an adjudication paper because he thought the child was his. The state sued him for child support and the judge ordered a paternity test. When the test came back showing my husband wasn't the father the judge threw it out and said he had to pay anyway. She always told him the child was his when in fact she knew the truth. Can't we sue her for fraud or something like that? He went to court on this 3 yrs ago. He does not remember if he signed the B/C or not.
