Cool

well i am not to happy to say the least.
OF COURSE "idiot" didn't show, so i don't have my child nor do i have the money.
judge said they have to give him until the 20th nov to respond to whatever docs they sent him and then he will process the courtorder through the south carolina courts. he also issued this warrant capia or something like that, if he gets pulled over by police for any reason he will be arrested and the judge set bail for $2000 in that case. the idiot has NEVER GOTTEN pulled over so fat chance there. with the order going through south carolina courts it can take a while before i have terry back also. as far as the child support is concerned, go eat dirt stenny. they will go through the military to get his retirement which will take 30days *know how the mil. system works* and he is supposed to pay $200 on the back child support per month starting the 5th dec , however it takes longer than that to get the docs processed and the payments started with the mil. involved etc. so that means, i MAY be able to at least pay rent the beginning of dec but if i see nothing by then i will be without a roof over the head by january. amazing how people can get away with things, they would arrest my behind if i would steal a stick of gum at walmart i am sure, this idiot gets away with everything for a while and by the times everything goes through i am evicted and don't know where to go...
so, that's the story *s*

Apart from the CS, this is not as bad as you say.. it basically means that you will be getting Terry back and your ex is in big trouble. Pretty soon, an order will be issued in SC to take the child away from him and to arrest your ex.

If he does not do as the court orders, you can always call his command and tell them that he is going against a court order. They may ask you to provide some sort of proof.
Her ex is no longer in the military, he is retired. She is going to have to pursue this through the State(s) court system.

ladyblu u are correct he is retired and they are going after his retirement. i am certain that he is going through the courts now to get it lowered. i am sure they'll be happy to hear from him since they will receive this new courtorder that our court is going to process through south carolina for the return of the child.

BOY do I HAVE QUESTIONS *G* CS AND RETURN OF TERRY

question

the attorney that was at the hearing with me was not the owner of the lawfirm *whom i spoke with initially* and that young man was rushing back and forth and hardly had any time to answer any of my questions, he seemed that he just wanted to get me in there and out.

ok, they will get the ex's military retirement pay, which still is not the full amt of what i should get on a monthly bases including the $200 per month to start paying back on what he owes me since january 2000.
this means that he will still be a few hundred dollars short each month. how can i get the remainder? will they *atty's ofc* go through the employer to get the remainder or how does this work?
i can't all their ofc because when i leave for work in the morning they are not open yet, when i come home from work they are already closed, when i try to call during lunch my paralegal is at lunch as well and the atty is not there either. so i sent them an email yesterday with my concerns but haven't heard anything so far. whatelse can i do to find out what the procedures will be? it seemed as if the atty either didn't hear my question when i told him that the military retirement pay will not cover the whole amt or he ignored the question.
also, the texas court will issue another courtorder through the south carolina court to have the ex return my son besides them issuing the capia *is this the right name for it* order. both will be issued/processed on the 20th nov. the judge said that they have to give the idiot 20 days to respond to the initial courtorder , which makes it the 20th nov, before they can process the courtorder or the warrant.
i would like to know how long does it APPROXIMATELY take to go from here to the south carolina court to the idiot and for me to have my son back?
i guess what i am asking is, what is the usual timeframe and when could i expect to have terry back?
i am also sure that the idiot is going to try to lower the monthly payments since the job he is holding now does not pay him nearly as much as the one that he held when the amt of childsupport was set. ladyblu told me that, in order for him to lower the CS he would have to get a texas attorney *since div. was filed here and childsupport was set here*, and also appear for a hearing for his matter in the texas court. so, if he should go through this court system and he appears in the texas court, will he be arrested for ignoring the initial courtorder to appear for the hearing and for not returning the child, since a warrant will be processessed against him? if he should appear for the hearing to get his childsupport lowered AND brings terry home at that time, will he still be arrested?
to tell you all the truth, i would LOVE to hear that clicking sound of handcuffs after what he has and is putting me through.

DID I CONFUSE ANYONE?
*g*
