| Ok, we have wrote up an agreement as far as custody of our child. I will be moving out in the next 2-3 months. What is our next step? We don't want to divorce just yet, but get legally separated. How do we make our "custody agreement" legal? How do we file for a separation? Do we need a lawyer? How much will it cost? HELP! I'm in Iowa. Thanks!! |

| In most states, a custody agreement between the parents is honored unless attacked in a custody hearing. Although the agreement does not have to be in writing, there are a lot of good reasons for putting it in writing, dating it, and having both parents sign it. To file for a separation, go to the court clerk and get the proper forms. You can then enter your custody agreement as a stipulation in the separation hearing. If you and your spouse agree to everything, you should be able to do this without a lawyer. |

| Thanks for the info! The custody agreement, should we get in notorized when we sign it? We have agreed to all of the terms in it, and will be going by it. Should we have it notorized before we go to the clerk of courts for a separation? And to get legally separated, do we have to go to court for that or can we just file papers? |
