Question

The divorce papers are currently in the 90 day waiting process. We purchased a house and property approximately 6 months before this happened. In those papers was an agreement written by me and signed by both of us that she was to give up rights and responsibilities to the house and property AND that since we are both still living in the same house, I am paying ALL the bills and mortgage while she is paying me rent. Since then she decided that she is unwilling to sign a quitclaim deed. Is she obligated to sign it? I am also in the process of having the loan transferred to just my name. Does this give me any more rights to the property?

Hey Jeff,
My parents are in a very similar situation. They built a new house 7 months ago and may now get a divorce. Now in your case, had that form never been filled out, who would be the one to get the house (assuming both you & your wife both want the house)? And has she always been paying rent?
