I was a petitioner for a disolution of marriage. I have found an attorney. Not a good one but decent she is said to be sneaky. I have received offers from my in-laws to help with debt accounts that were left in my name by their son. They wish to settle matters with me out of court. They said by going to court they are wasting money because we can't be civilized. They are willing to give me the money instead of hiring an attorney for their son. I think I can trust my father in law. The reason why they are so involved is because their son is 21 and I am 20. We are still very young. They are afraid of what we do will affect the future for the both of us forever. I also have a two year old son by their son. I don't know whether to settle out of court or to continue with my lawyer who is sucking all this money from me which is getting nowhere because I have yet to appear in court. What should I do? Help!!!!!!!!

In other words, they are willing to give you enough money to help take care of your debts so that you don't bleed their son dry of money in the divorce? In that case, make it legal that they are going to give you this "settlement" in the divorce. You can do an uncontested divorce which takes less time ONLY if you can agree on the terms of custody for your child.

I would not "trust" your soon to be ex inlaws if you what to settle this out of court great it is cheaper, but get your lawyer, or some one from a legal aid, or a medatator to draw up the papers. Make sure you "leave no loop holes" before you ask a judge to sign the papers make sure every thing is in there and understood; visitation the hows and the when's, future support and who is reponsible for any thing that might come up in the future; medical bills schools chioce and tution as well as who pays the outstanding bills and who get custody and assets. Once the judge signs the agreement it is very hard to change many of these issues. good luck ------------------
