Help- my sister in MO is considering leaving spouse and returning home to family support in another state- does she have to give notice? what does she have to do for removal of chidren to be legal?

I would think she wouldn't because after all, they are still married and therefore noone has more custody over the other. Even if he were to go the police and get them to come along, they can't force the mother to hand over the children b/c THERE IS NO CUSTODY ORDER!!
