Hello I have a situation where my 13 year old son has come to live with me and has been here for the past 6 months his mother brought him to me because she was tired of dealing with his behavior problems he has always expressed interest in living with me and that is what he wants however his sister lives with his mother and I still pay child support we have worked it since I have one and she has the other I figured us to be even but apparently if we were to have the support changed so neither of us would pay the state wouldn't view it that way since she makes alot more money than I do she would have to pay me this she absolutely refuses to consider that and has threatened to take him back if that was to occur she would do anything not to pay me and possibly use domestic problems that we had togeather 11 years ago to make me look bad in the courts eyes. Can my son decide on his own accord who he shall live with? Which would eliminate the situation between me and his mother by making it his decision. The state in which we reside is Washington state.

At 13 the childs view could be heard by a judge. Things that happened 11 years ago will have no bearing on the situation.

You continue to pay the court ordered amount until otherwise ordered, so if you have recently stopped, then you are behind.

You can, in the change of custody petition request for no CS. The judge will ask why and may allow it. If not, then she will have no choice but to pay and it would be unlikely she could turn things aroung and get your son back.
