| I'm asking on behalf of my BF of 2 years. He just recently found out a woman he had a 1 night stand with had a child and the state of Minnesota is going after him for child support. They adjusted according to a job he had when they began the process less than 1 1/2 years ago. He agreed to this amount and just got paperwork w/in the last week that this amount has been increased. The original amount was high enough; bills are barely being paid now as it is. In the last 12 months he's been employed about 4-5 months. So things are very hard now. He also got information stating that a certain amount from his tax return will be withheld this year, if not all of it. He also has a child that he has been supporting and sees every other weekend for the past 3 years. Can this amount being paid be used to adjust in what he has to pay to MN? My other question is about giving up parental rights. He lives over 1000 miles away and will never see this child and really wants nothing to do with the child and it's mother. If he gives up parentage does he still have to pay child support? This affects our future as a couple talking about marriage and having a family of our own. What are your best suggestions and advice? We are not sure what should and should not be done. We can't afford to get an attorney to fight through anything. This situation doesn't seem very fair that he has no rights. That he has no say in the matter. Please help in whatever way possible. Thanks! |

I know that you said you can't afford it...but, if you want action you need to get a lawyer. As far as giving up the 'parental rights' did the mother ask for this? I don't believe that you can do this unless both parents agree - because that would mean no child support would be collected. As far as your friend having another child, the court should have included that in the modification of the child support order. Weren't you notified in advance of the support modification? |

| Is the state of mn colecting support or arears or both...The mother of the child may know nothing about this..with new fed laws and the uniform cs collections act..it could be the state or county that she lives in doing the collecting....without her knowledge. Talk to the mother: has she been on aid? if she has the county will collect from you, any back support. (you can pay this back at a low montly amount) Any court ordered support you will have to pay regardless...you can only have that lowered by petition... See if the mother will relinquish the support..she can sign saying she don't want it....then you can negotiate w/ the DA on how much you owe on arrears, and how much you can afford to pay a month to pay it off.... If you live in another state they need a "forign suppot order" form your county to cllect from you |

| Val H & Terdad... Thanks for your replies, we need all the advice we can. Val...no he was not notified of any modification until after the fact...after the entry of judgement...I've done a lot of research and the amount they are taking out has no consideration for his 3 y/o that he sees & supports. Terdad...yes we are in a dif state, FL, and no he hasn't seen anything regarding that support order...he will have to ask about that. He's going to call the mother and ask her to start termination of his rights. Thanks for the url we'll have to check that out. Again thanks to your both...think of anything us let us know. |
