stepson's bio mom coming back after 2 yrs

My husband and I are in a custody battle for his seven year old. He was left with the bio mom's mom two years ago. We first went to counseling with the GP to work on what best for the child. Since his mom had left is was belived that instead of picking him up and moving him right away he should spend more and more time with us till t was a natual fit in our home. When it came time to register him for school the GP filed for custody. Now one year later we have a court date. The problem is the bio mom is moving back into her mothers home with her new husband and twins. Our son now wants to live with "mommy" he did want to live with us, before all this happened. Any advice on what to say to our son?

The problem is, they have access to the child and can easily effect his decision. Follow through with the court date. It sounds like you have good grounds for gaining custody..

Thanks for your support. He is seven the bio mom has custody, she has given her permission to have him live with her mom. She has said that she would have us arrested for contempt if we do not return him to the GM at the end of the weekend. In Texas the custody manager can choose where the child resides even if it is not with them. Thats why we have been in court for over a year, their side has had six continuences, and we had to sue them to get a court date. We have one in three weeks. In the past two years the bio mom has been starting her new life with her new husband, who did not want her son in the picture. Now with the court date loomimg, they suddenly want back in his life. My feelings are they have been told by thier attorney that the child support payments will go away. The bio mom has only made appearences when we have let her know that her son needs to see her. In the past two years she has seen him for a day about 10 times.

Just make sure you have all that documented. Regardless of whether the Custody Manager can put the child where they like, some courts would rather see the child with the parents and if they see that the bio mom has little interest, then they may change the custody.
