I push my wife off the bed after asking her to perform oral sex and she denied. We had just come from a nudists club and were heavily intoxicated. When falling she hit her right eye and leg on the dresser that is positioned on the side of the bed. She filed for temporary injunction and took my two sons who are 10 & 11. I am a 44 yr old black male and she is a 43 yr old white female. We've been married for 23 yrs. And I have no history of domestic violence. I love my wife and kids very much and i want to try to save the marriage. We both currently live in the state of Florida. I'm very ashamed of myself and I quit drinking a while back but I drank that night. This is not an excuse for pushing my wife but she suffers mild to severe manic depression, and she smokes cigarettes ( I don't), and she drinks constantly at a mild level, and suffers from a lung disease called ADS. I have family support she does not. I have a 19 yr old daughter who can vouch that I'm a good father and knows the whole truth and is willing to testify. My wife is in a safe home and has legal and psychiatric help and is going by the law and trying to get custody and possibly child support and allomony. I need to know my legal defense as well as how good of a case I can bring to get custody at the temporary injunction hearing and do I need a lawyer at the hearing? I LOVE my wife and kids very much and I want to keep us as a family. I don't do any drugs and I will never drink again. HELP PLEASE!

I can not help you on the emotional side.. but form a legal angle, you will have little chance of custody with this domestic violence charge hanging over your head.
