I was married in 96. I had a daughter from a previous relationship. My husband wanted to adopt my daughter so that her bio father would not contact me anymore. I was pregant with our child and my husband said that if I didnt have her bio father sign a paper stating that my husband could adopt her - he would leave me. So my daughters bio father went and signed the consent to adopt paper in court.

My question is this: I have seperated from husband and plan to divorce him( He was very abusive to me)

My daughter was never adopted by my husband - the adoption never went further then her bio father signing the consent to adopt.

My question is this - who is legally responsiable for my daughter? Do I have to file for custody of her and what about child support( Iam on assistance and they have not collected anything)? I plan on gettign off assistance soon.

I live in VA and my daughter is 5 years old

First I would like to offer my congratulations at spliting from such a man. There is no excuse for abuse.

Second, in answer to your question, the original bio father is still responsible for your first child...

Third, you always need court papers for custody and child support. If you have non, you need to get some.
