Question

Here is my situation. My son is almost 3 years old, and has had no support from or contact with his biodad since he was 3 months old. I have heard nothing from him at all. I happened to run into him tonight, and he said, with no hesitation, that he would relinquish his parental rights if I had the papers for him to sign. I am not married, engaged, or even seeing anyone for an adoption to come into the picture. My son and I live with my parents in a stable, loving environment. I want absolutely nothing from the ex. I need to know what is involved in having his rights terminated, since it would be voluntary on his part. I live in Texas, by the way. I also need to know if abandonment would possibly become an issue and make my life easier. I'm hoping the cost of the paperwork would not be an issue, but any ballpark figures anyone could give would be great. Any advice at all would be great! I would also have to change my son's last name; I gave him biodad's name. Big mistake! Live and learn, I guess. Anyway, any help at all would be appreciated.

I don't know how things are in Texas, but here in Indiana, a father cannot terminate his rights unless there is ANOTHER man willing to take on the financial responsibility. Whether you agree to it or not. Abandonment may be an issue. I'd call a family law attorney and see if they offer free consultations. Go in and talk to someone. Best of luck.
