I am the non-custodial parent of an eighteen year old who no longer lives with the custodial parent. This eighteen year old is lving in an apt but has re enrolled in school(high school). I do not pay child support through the courts, but directly to the other parent. Am I still obligated to pay child support? We are both Illinois residence.

I might be wrong, but if your daughter is emancipated and living on her own, you no longer pay child support to the custodial parent.

You do not have to pay child support, however, you should still file this in court. My husband and I are on the verge of one of his children from a previous marriage turning 18 and graduating from high school and even though it is spelled out in their Marital Settlement Agreement that support terminates upon graduation from high school or reaching 18(whichever is later)or emancipation, we still need to file in court when we terminate the support for that child. Be careful.

Child support laws do differ. For instance, in Calif, the law states that child support is owed until a child turns 18. (Clearly, that's not the issue here. Child is 18, so no child support is owed any more. Simple!)

BUT, the law goes on to say that if the child remains in high school, then child support is owed until age 19! Again, this is Calif. law. And I bring this up only to tell you to consult w/ a family law atty in your state and ask if there is more to the child support law there. If your state has a similar law as in Calif, then dad might have to owe child support still since kid is still in high school!
