I need legal advice for my fiance. His child's mother is denying himn visitation rights of his child because he is with me. What can he do? He went to get advice from a lawyer about putting himself on child support. The lady told him if he files and the mother does not show up to court they will just throw it out. is there something he can do. I have to hold him at night when he cries. He loves his child and wants to take care of her but the mother is denying him of his happiness. What can he do?

similar situation! i am confused too. my hubbys baby is seven mos old and he still hasnt seen her because bm is so upset he isnt with her. so we have a pretrial date in couple of weeks. dont know what will happen . but we are asking for rotating holidays, rot. weekends, and summer time for 5 weeks. which is what our court gives as a minimum . our attorney seems to think it will fly. i hope. we have missed out on so much of this childs life already. he is goin gto miss he crawling at this rate. the system is so slow!

Ok, let me understand..

He has a court order in place? He is ordered to pay child support or not? Explain yourself a little better. Is he listed on the birth certificate as the father? Were they married? Divorced? How old is the child? Need more info before anyone can answer you.

Andrea Wells: Get an attorney and file for proper court ordered visitation. Simple as that!

She will be 2 in Dec. They were never together. He wants to put himself on child support. He thinks if he does this will give him some visitation rights.He is listed on the Birth certificate and the child has his last name. He has participated in her life that is until I came along. Now she is using the child against him.

Same advice, get an attorney and file a petition for proper court ordered visitation. Giving her money for CS will not buy him a visit, a judge ordering her will.
