LegalBeagle & Others who were interested in an update:

I saw my attorney today and she looked at all my documentation, etc and told me that I have an EXCELLENT chance of being awarded custody of my son. Based on actions of his father the past 3 years and my son being willing to tell the judge what he wants/needs.

Hopefully my ex will be served with the petition next week and we will begin the required mediation early November. If we can't reach an agreement through mediation, we'll be in court sometime in December.

She is pretty confident that we have a good case.

Now, does anyone have an extra $1500 retainer lying around I can borrow?

Good for you !!... I always said it was down to why he should not have custody.. and of course I was unable to look at your documentation.

The sooner the better...
