Question

I live in Virginia and have sole custody of my daughter. My ex, who does not exercise his visitation regularly, wants to pickup our daughter for an overnight stay. He has recently moved and I don't know the address or phone number. More importantly I don't know what type of living conditions or arrangements he has at his new home. I don't want to keep our daughter from him but I want to know where she is going to be and what type of sleeping arrangements there are. Does anyone have know how the law works in this type of situation? Thank you.

If you have sole custody, then you can decided when and where he visits the daughter. I'm assuming that he has no detailed visitation in order, I wouldn't allow that to happen until you know more about the situation. I would refuse the overnight visit, and let him know the reasons. If he has nothing to hide, and wants to pursue this he will invite you over to look at his place, and supply you with all of the info that you want and need. No need to refuse visitation to him, just refuse THAT SORT OF VISITATION until you are more comfortable. Work something else out with him. Good luck!
