Wife and I are talking divorce. She has stated that she would like to keep the house and this is fine w/ me. I would like to buy another house. To do so, I would have to get my name removed from the mortgage and get my half of the equity (about 15k). First question-is there any way to have my name removed from the mortgage w/o her having to refinance the loan? Question 2-since she does not have $15k in cash, could a QDRO be used to transfer that amount directly to me from her 401k and could I use that money for a down payment on a home w/o anyone incurring the taxes or penalties? |
