I am about to be laid off from work. I pay $500/month in CS. WHat will happen when I am out of work? If I take a lower paying job will my CS still be based on what I was making at my previous job? I do not have a collefe degree. My wife makes over $2000/month can her wages be garnished if I can not pay? I am in AL. If her wages can be garnished what can I do to not let this happen? Thank you.

In order to get your support payments lowered you would need to petition the court for a modification. Your unemployment will be counted as income to cover the CS payments, and most likely the court will only allow a temporary modification. If you take a lower paying job, you will probably still be expected to pay the $500.00 CS because that figure is based on what you are capable of making. Your wife's wages are not considered in factoring the amount of support you are required to pay.

Part of that is true. My ex's income is included in the amount that I pay. Can you show me where I can find this information because I find it hard to beleive that since I happened upon a decent paying job without a college degree that I am still expected to pay so much even though I can not find another job that pays me that much. I would be willing to take the first job that I can get that works around my schedule (kids on weekends and school at night). if it is paying $6.00 I will take it until I can find better. But I would really find it hard to beleive that i would have to pay $500/month if I only bring home after taxes and insurance $20. Why would I work? Please refer me to where I can find this info. please. Thank you for your response. I am not trying to sound ungrateful!

The reasons for the laws being set up that way is so that men/women that are ordered to pay support do not walk away from decent paying jobs and go to work for minimum wage just to get paymetns lowered... so dotn believe me, when you are working for $6.00 an hour and all your pay is going out for the child support you will realize I was speaking the truth.

My lawyer has said conidering the circimstances, no I would get it changed to a lower amount if I can not find somthing better. So, yes, you were incorrect. Thank you.

My response:

Please, when you get out of court, with your new child support orders, tell us they weren't temporary orders, and that the judge isn't "imputing" a certain amount of "earning capacity" to you with a time limit for you to obtain a higher paying job again.

Then come back and tell us that LadyBlu was wrong. Remember, it ain't over until the Fat Lady sings (the judge).
