Question

My hubby has a child from a previous relationship. He was never married to the Bio-mom of his child. There was never a divorce, so there is nothing legally set up, except of course for child support.

My question is this: Should he be able to obtain information from his daughter's Dr./Dentist? There is nothing saying that he can get the info, but there also isn't anything banning him from the information either. His name is on the birth certificate, and his daughter has his last name.

My feeling is that he should be able to get any and all information in regard to his daughter, since there is nothing stating that he can't. Am I correct in assuming this?

The reason I am asking is, recently we have been informed by a third party that Bio-Mom is neglecting his daughter's physical well being. Not taking her to the Dr. when she needs to go, no dentist appt. ever made, until the child's school sent paperwork home with her that she HAD to go to the dentist.

We do see the child every weekend, but don't want to drill her for information, we feel that it would be detramental to the child. I do feel however, that my husband has the right to know if his child is being taken care of properly!!

YES your husband should have rights to his daughters medical records.
You should have no problems getting them . ONLY he can get them they will not give it over to you. I hope everything is going good . The only thing I can come up with is maybe she does not have enough money . Does your husband have insurance on her ? the reason why i ask is because if you do not and you pursue this to court they will probably court order your husband to carry some . So good luck !!

My husband's daughter does have health insurance through a State Funded program. It doesn't cost Bio-mom anything. Dr's and or Dentist visits are covered. We have attempted to get the child on my health insurance, but the Bio-mother doesn't want to do it. It would have to go before the court because the insurance is through my employer. They will not allow me to put her on the insurance without a court order.
