what if marriage certificate was never filed?

In Arizona, if you were married by a justice of the peace, but NEVER filed the certificate from the JOP with the courthouse, are you legally married? I now live in Louisiana, and neither Louisiana nor Arizona recognize a common law marriage. This is very important to us for other reasons, and I would greatly appreciate any advice, or information on how to find out.

My response:

This is a common occurrence. The filing of a marriage certificate is a "formality". That procedure is a matter between the State of Arizona and the JOP, and has nothing to do with you. Remember, despite the fact that the marriage certificate wasn't filed, that doesn't mean that the JOP never married you, that witnesses didn't see and hear you get married, and that the marriage wasn't proper under the law.

So, yes, you are married - and please, don't take a chance on Bigamy. Get the divorce first; which you can get anywhere.
