| After reading a few of the custody posts, I started wondering about my own situation. My daughter's father and I were never married, so there is no divorce decree stating who has what custody. I am assuming I have AT LEAST sole physical custody since she lives with me and he has not filed for visitation nor has he even seen her since she was a few days old (she is now 7 months old). Do we have to go to court and file for custody (I guess I should say do I have to go to court)? Or is it just set when she is born and residing with me? Her father signed an affidavit of paternity - does that make any difference?? |

And if he has clained the child, you are entitled to child support from him. I think he would have to take you to court to gain custody. good luck to you ![]() |
