Question

My husband wants MY children out of the house, they are his step children and we have a child in common also he wants MY kids out of the house, he owned the home before we got marriage so it is in his name alone who has to leave the house due to a screaming match the other day the police we called,and he wants us to go but all the children are minors I work a fulltime job but am only a temporary employee and make squat. Do I have the legal right to get him to leave until proper housing can be found for me and my children?

I am a law school graduate. WHat I offer is mere information, not to be construed as forming an attorney client relationship.

Problem here is this: it is his house, so unless there is a compelling reason why you should stay and he should go, he can consider them (the step kids) trespassers and make them leave. Now because they are minors it may not happen that way.

What I suggest: Contact your legal aid foundation (either call 411 and ask for legal OR call your STATE BAR and ask for legal aid foundation OR look up in your yellow pages under community services and then sub category legal services). When you get someone, ask their domestic violence or family law clinic if there is "precedent" or history on this and ask what should be the next step. THey may be able to help guide you through the process.
