| I am a mother of a six year old. his father and I have joint legal and physical custody. My son lives with his dad during the school year and me in the summer. We both pay for all expenses equally. Now my ex wants child support. Are their factors considered before I will have to pay him? Is their a possibility that I will not be required to pay it? I am in Illinois. The court will take into consideration the child's needs, and the income levels, or imputed levels, of both parents. Both parents have an equal responsibility for the care and support of their child. So, yes, you could be ordered to pay support while the child is in the custody of the father.
