I am looking to sell a building with a multi use building, commercial on the ground and an apartment. we had reserved one of the rooms for our employee to rest and might stay a night if/when they work late. our real estate agent formed that having someone be there or stay there could be a problem for the next buyer. Here's the excerpt.

Benefits- a room for rest breaks is provided due to the hours you work, shall your employment end that the room is to be returned to the company

whats the best way to handle this when we have buyers looking? thanks

Don't give him the room any more.

Once you find a buyer and open escrow, on that day you give your employee notice that is his employment is terminated on such and such a date and he is to be out of the room by them.

He's not a tenant so you don't have to give him any notice at all, unless you want to.

You'll want to make sure he's out before close of escrow otherwise you might end up with the closing delayed or the sale cancelled.
