Sick leaveWhat is the name of your state (only U.S. law)? Texas If you come to work and are sick, and if your employer says you need to go home because you are sick, since they are sending you home, can they make you use your sick leave or do they have to give you that day since they are the ones that told you to go home? |

| I'll try to make this as easy as I can. No matter what the circumstances, they can require you to use your sick leave when you are sick. Even if you came to work, were ready to work, and they sent you home. Sick leave is to use when you are sick. There are NO circumstances whatsoever under which it is illegal for them to require you to use sick leave when you are sick. No matter what. I hope that this is now clear to you. |

| And trying to go to work while you're sick, just so you can be non-productive and infect your co-workers, is extremely selfish and stupid.

| Disagree, sometimes not selfish not stupid, just need the job, need the money. And what about the employers who require a doctor's excuse, even though you know you don't need to go to the doctor and have no insurance to do it with? If you're in danger of being fired for absenteeism, get that doctor's statement, because it will be important to unemployment insurance, though it may not save you from being fired by your employer. Particularly if you don't get paid if you don't work the day the motivation to try to work sick would be tremendous. I have seen employees who were actually line cooks in restaurants be fired for staying home when they had the active flu. Then, on the other hand, I once occupied an office with Typhoid Mary, who bragged to anyone who would listen that she had never took a day of sick leave, unlike the rest of us wimps. She was forever coming to work sick and infecting everyone else with her nasty viruses. If I had been her supervisor, I would certainly have insisted she go home, because we worked with the public, many small children. But at least her only loss if sent home would have been a day of sick leave. We were lucky to have jobs where sick leave was an option. |
