What is the name of your state (only U.S. law)?

Why would an employer keep a Tax Deferred Annuity Plan in a terminated employee's name? When the employee left she was not vested. Employer did not notify the plan administrator and subsequently the account under the employee name was in fact list as vested?

What's the advantage to the employer in doing this if it is their money anyway?

Are you so sure the employee was not vested?

Our plan document specifically states that under several different circumstances, employee will vest immediately. We've also seen it happen many times that the employee knows exactly what day they will vest and time their voluntary termination according, leading to some paperwork saying they are not vested and other paperwork saying they are, based on when the paperwork is created in relation to the last deductions posting.
