An employee resigned without notice from our office who had a few hours of accrued vacation. Are we liable to pay it to this person? We have no written policy on this issue and there is no documented proof of how many hours were accrued when the person abruptly resigned.

Are we liable to pay it to this person? Yep. MD considers vacation pay to be wages and thus earned but unused vacation must be paid out upon separation.

We have no written policy on this issue and there is no documented proof of how many hours were accrued when the person abruptly resigned. Then you'd better figure something out. It's the employer's responsibility to track accrual of vacation and provide an accurate payout to the employee if he/she leaves.

I'm a Northern Girl
According to my most recent information, in Maryland you must pay out accrued but unused vacation time at termination unless you have a clear policy indicating the circumstances under which you won't.
