We have a case where an abusive parent, who is now a grandparent is trying to get visitation with an 8-month old grandchild. The parents of the child are married, the child has never had any relationship with the grandparent, but the grandparent has abused his daughter all her life and this is currently the only way he can find to get to her..... The mother is desperately afraid that if he gets his hands on this child that he will be abused, and the child is too young even to be able to tell anyone if he is. Is there any way a judge would issue a court order for grandparents visitation when both parents, who are married, do not wish the grandfather to have any access to the child? |
the fact that both legal parents agree, less likely
the fact that the "grandpa" doesn't have an established relationship with the child, even less likely.
if "grandpa" decides to take this to court, say no to everything in mediation. do not agree to anything. not even supervised visitation. let a judge decide if the case has merit.
