Your attorney would still need to argue it, and be fully prepared that they will simply postpone and have the petition amended and their father served.

He still needs to be served. He has a constitutional right to his children.

I understand that, just wasn't sure if it really mattered what he said? He and I only have the one child, my youngest is mine and my current spouse.

Since he is a non-involved parent it won't matter much, but he still must be served.

Ask the attorney what kind of experience he has defending parents in grandparent visitation cases. Let the attorney know that you do not intend to settle or mediate and make sure that he/she is on board with that. If not, find somebody else.
