Would the other parents opinion matter? He hasn't been in child's life for 4 years, and doesn't know the circumstances

I understand that, just wasn't sure if it really mattered what he said? He and I only have the one child, my youngest is mine and my current spouse.

Since he is a non-involved parent it won't matter much, but he still must be served.

Ask the attorney what kind of experience he has defending parents in grandparent visitation cases. Let the attorney know that you do not intend to settle or mediate and make sure that he/she is on board with that. If not, find somebody else.
