TN cps took custody of grandkids n grandparents in NY want them how do we do it

What is the name of your state (only U.S. law)? TENN and NY

TN cps took custody of 4 month old and 2 year old from both parents. We do not know the whole story yet. Both children are in foster homes in Knoxville TN both parents are in Knoxville TN. Grandparents are in NY. Grandparents have employment,nice home and clean backgrounds. Grandparents want the children and both parents will sign over children to grandparents. WHAT DO WE DO? We do not have lawyer money and can afford a few trips to TN but not many. How do we get these babies? Can someone please point us in the right direction? Thank you.

You need to have an ICPC completed and NY to talk to TENN. Then you need to make sure that the court knows you want custody. If they are working towards reunification, you might not get the children moved to NY since it would be difficult to reunify with parents in TN in that case. HOwever for a concurrent permanency plan, it is definitely something that can happen. Contact the caseworker.

We are only seeking emergency or temorary custody for now. I looked up the icpc but that says its for adoptions...but is it also needed for temp custody? NY cps has told us they cannot help with that but a 2nd cps person said we can use NY family court. A longtime lawyer friend in NY stated it has to be done in Tenn?? The permanacy hearing is in TN on wednesday and daughter has asked grandfather to come so should he go to that or will that just be 24hrs of drive time for nothing? What should he take to it? We were also told that daughter and husband should notorize a statement that they want grandfather to have custody...will that help?

Try again. COntact TN CPS who have the children. They (TN courts) have jurisdiction. NY courts do NOT. CPS is stupid. How is it a permanency hearing already? How long have the children been in custody of CPS that they are seeking permanency?

From what Ive read a permanency hearing within 30 days one site says is normal another site says that means CPS have no intentions of giving them back to the parents. Again we do not know what the parents have done or allowed to be done. The offense(s) are being called "severe child abuse" but thats all we can get due to privacy policy ofcourse.

You MUST let CPS in TN know that you exist and want placement of the children. I would also recommend that grandpa go to that hearing if at all possible and let the judge know that as well.

Thank you. He will be going to that hearing. Hes going down a day early and going to cps 1st to talk to whoever he can get. What documents should he have? Should he have notorized statements from both parents giving him custody? We both really appreciate all of your help.

The parents do NOT have the authority to give him custody because there is an open CPS court case. They lost that right when CPS got involved. What he needs to have is as much information as possible about everyone in his household. He also needs to realize that an ICPC can take six months to complete.

Yes we know they cant give us custody as cps has that but we have been told it does help if the parents also want us to jhave the custody. The parents have had 2 visits scheduled and the foster parent has cancelled both. They have already talked to mom about giving away her rights so my husband is going as it sounds as if they are trying to steal these babies and if so they are about to get one hell of a fight. Its almost as if they want to adopt them out. Thank you so much for your help. Mom and dad might have some issues and they may or may not deserve to ever have these kids but we are good people and these are two wonderful little girls.
