I am the HR department for my company. As a part of their hiring agreement, some of our employees were guaranteed health insurance. Our company (company A) does not provide health insurance for it's employees, so these couple of employees were signed up under a health insurance plan for another company (company B) that our owners have. These employees were listed as employees of company B, when they are actually employees of company A. The two companies operate independently. Is this considered insurance fraud? An if it is, am I liable in any way?
