COBRA-failure to get enrolled


What is the name of your state (only U.S. law)? Kentucky
My husband's new job did not start coverage until July, so we enrolled in COBRA for June. I sent about 6 pages of paperwork and $1115.84 to the third party administrator, Paypro. They cashed the check 6/24/09. I recently started getting bills returned to me for June, so I contacted Paypro and they say I was never enrolled ! They said they did not have enough info and requested I send more on 6/25/09. I never received this.
So, now they will not do anything since we are past the 60 day period. They offered to send back my $1115.84. Problem is, we had $2900 in bills in June. What can I do since they cashed our check and as far as I am concerned never contacted me and now we have $2900 in med bills.

What day did the previous plan terminate? Was your premium payment sufficient to cover the entire time from termination date until 6/30?

Thank you for reading! The old plan terminated on 5/31/09. Yes, the amount sent was enough for coverage until 6/30/01. My spouse's new job started our coverage with a new carrier on 7/1/09.

Any suggestions?

As long as you filled the paperwork out completely and correctly and sent it in with the payment, you should have been enrolled. You can try complaining to the department of insurance or maybe the DOL.

The DOL is the regulatory agency for COBRA issues.
