Its certainly legal (and common practice) for a doctor to offer a discount to someone who is private pay, so yes, its legal to charge more to a patient who has health insurance.

It's not legal for a doctor to charge more BECAUSE you have health insurance. But I'm sure that's not what's happening. The doctor, if in network, will have negotiated the prices for service with your insurance company and after the bill is processed, you will be charged the discounted rate (even if the whole thing goes towards your deductible).
