Fiancee pregnant covered under ex-husband?

I met my fiancee in December of last year and we fell in love very fast and were engaged in no time. When we met she was going thru a rough divorce and now things are really confusing. We just found out that she is 20 weeks pregnant with my child. The problem is is that she is still under her ex-husband's insurance. The court ordered no changes until everything in the divorce is settled. She tells me that his insurance can only be changed 2 times a year so she will be covered thru december. Will her ex-husband's insurance cover her maternity costs even though he is not the father of the child she is carrying?
And if it wont cover the maternity costs, what are our options? I have insurance but she isnt on it and if she got added it would be a pre-existing condition, I belive. Please verify that fact for me also. Same problem of pre-existing if she signs on with her employer's insurance I think. Please someone check my facts about a pregnancy being pre-existing and if her ex's insurance will cover the birth of child that is not his. If her ex's inurance will not cover, how can we get some form of coverage for her while she is going thru this pregnancy?

the divorce is final, but she is telling me that because of the court order, he is not allowed to remove her till the divorce settlement is complete which will not be for a while still. Does that clarify better?

Thanks, but for your info, she has had none of the signs, not one, not even gaining weight. Multiple doctors have missed it too, and the doctor that finally caught it said that this does happen, rare but some women never experience the symptoms. So layoff, Im not from GA originally, neither is she.

Obviously, at the very least, she has been "Georgiafied". She hasn't had a period in over 4 months. Just where did she did she think it went?

Of course "multiple doctors have missed it." They're from Georgia too!

Didn't you know? Everyone that comes to these forums has a disorder or a disability - - mental or physical. Nobody's normal around here. So, why would I expect you and yours be any different?

Once the divorce becomes final, the wife is no longer a dependent under the insurance contract and cannot be continued. She has the option of electing COBRA coverage.

When a claim is filed if the carrier does their investigation (which is likely) and they determine she was officially inelible for coverage on a particular date her coverage will be terminated retroactive to that date (or the end of that month).

My guess is you cannot add her to your plan since she is not a legal dependent.

She had the option of taking her employers coverage in lieu of COBRA and the pregnancy could have been covered. That option may still be viable, just depends on when her coverage should have ended under her ex-husbands plan.

For what it's worth, GA has not outlawed birth control devices & medication, and medical science has made significant advances in the last few years. We now know what causes pregnancy . . .

To the OP, you may want to speak to the insuarnce company. It may be possible for her to continue with thiat policy and she pay her own premiums. They have already started to cover her for this, I think it is just as if you left a job, you can continue with the insurance you have, she may just have to pay a higher premiun since this is ex-husbands insurance and she does not qualify for the discount through his company. Just my thought, but I think it is worth looking into. Good Luck and God Speed

The issue here is, when did the divorce become final. Is she still in the COBRA election window? Even if that has passed will the carrier allow her to back-date her application due to an oversight?

She cannot continue on the group other than as a COBRA participant and that option may have expired.
