Question

Haven't Received Medical Bill


What is the name of your state (only U.S. law)? Kansas

I gave birth in a birthing center that was an out of network provider in April 08, with the understanding that I'd be responsible for 40% of the bill since they are out of network. I have no received a bill yet for the services they provided. I've called them several times and each time they say the insurance company hasn't paid their share. I call the insurance company and they've never received a claim, so I call the birthing center back and verify all my information, Name, DOB, & Ins #. They say the ins # they used was wrong they'll resubmit. It's been 5 months, we are planning on using money we put into an FSA to pay the bill. But we are planning on moving out of state, and getting different jobs & insurance, if this happens we lose the FSA, and we can't afford to pay for the bill out of pocket and lose the $2k in FSA. At any point are no longer responsible for the bill due to non-billing? We would just give them the money in the FSA but we need detailed billing to get the FSA money. I've asked them to just send me a bill for 40% of it so we can pay it and they can deal w/the insurance as long as they want. It's not even the insurance company's fault, they still haven't received a claim.

Anything we should do that we haven't done yet?

At no point will you cease to owe the money just because they took a long time to bill you. What you haven't done is physically gone into the office and had them hand you a copy of the bill, which you can then submit to your insurance company.

I agree...Go to the office and get an itemized statement and submit it to your insurance company yourself.

Make sure they give the bill to you on either a UB92 or HCFA 1500 form, whichever they use. Your insurance probably will not accept a patient statement as it usually does not have all the provider information and coding numbers on it they need to pay the claim.

More than likely, since you are submitting the bill yourself and the provider is out of net, your insurance company will pay you and you will be responsible for sending it into the birthing center.
