Health Insurance


What is the name of your state (only U.S. law)? Wisconsin

My husband and I recently got married and he added me to his health insurance plan. A couple of weeks ago we received a statement saying that he will be charged a $100 surcharge/month if I have/am eligible for health insurance through my employer. I am covered under insurance through my employer and have been for years. Is it legal for them to charge him that surcharge just because I'm covered under my own insurance and his? He's the one paying the monthly premium to have me covered and his insurance is considered my secondary so I would think we're technically saving them money since they're only picking up what my insurance won't cover as opposed to them having to cover it all if I was to quit my job and have only his insurance.

Thoughts/advice anyone!?

Yes, it's legal. This is the sort of thing you should have found out about BEFORE signing up for the coverage as it's now too late to drop it (until open enrollment which might be soon). If you quit your job, that would be a qualifying event allowing you to sign up for his coverage at that time (within 30 days).
