I live in California. I have an 8 year son. I am currently unemployed and have no health care coverage. I just married on July 17th (2005) and while my husband obtained the forms to add myself and my son his company said there is an "issue" with adding my son on for coverage since my new husband is not the natural birth father. My question is, since we are now married and I
am his natural birth mother, do they have a right to deny him coverage? I found this statement under Californias womens rights issues that clearly states: A man is presumed to be the father of a child if any of the following conditions exist:The man receives the child into his own home and openly holds out the child as his own natural child. (BTW did I mention we've been domestic partners for 6 of the 8 years of my childs life). We are the sole supporters as he has no natural birth father on record for him. I'm confused as to is this an insurance question or a marriage question? Thanks for any help.
