Question

Insurance fraud??

What is the name of your state? North Carolina

I know someone that is divorced and was ordered by the courts to pay for insurance on his 2 children. He received insurance cards for both children and when he tried to give them to his ex, she refused them saying that she has them on the state's low income Medicaid plan where she doesn't have to pay a co-pay. I'm a little fuzzy on the law here but if I'm not mistaken, if a person has a private insurance provider and Medicaid, shouldn't the private insurance be used first? I mean this is a drain on the state's resources when there are others out there who could really use the service more. Isn't this insurance fraud? And if it is, should I report and to whom should I report it to?

It is fraud, sort of, she may not have fully disclosed dad's contributions in order to qualify for medicaid. But it's also not really any of your business.

I disagree with your logic. The children's father can contact medicaid if HE is concerned.
