My employer cancelled my insurance


What is the name of your state (only U.S. law)? Utah
My employer is cancelling my health benefits because they are saying I did not sign up for the benefits during my 90 day probation period. I started working for this employer on Nov. 24 2008 and I signed up for my benefits on Feb. 4 2009. Now clearly that is in the 90 day period. Myself and my son have both been to the doctor on and after April 1 2009 when my original effective date was, but the insurance company had the effective date of May 1 2009. Now my son and I will not be covered and my insurance is cancelled before the date of effectiveness. What can I do to straighten this issue out?

I did recieve the insurance cards and my employer has been taking money out of my checks for the benefits since the second week of april

What date did you become eligible for coverage?

My 90th day or one day after. I was told I should've been covered which the 90th day was Feb 24, but the owners wife told me the effective date was April 1 and the insurance said the effective date was on May 1.

There may have been an issue with them sending your application to the insurance company. If your application was not received and processed within 30 days of your eligibility date, then you would NOT be able to get on the insurance at all until open enrollment. Are you sure you completed the paperwork correctly and on time? They can't make you effective 4/1 or 5/1 if your eligibility date is 2/24, unless 4/1 or 5/1 is the start of your plan year.

I handed in my packet the very next day and I have copies of the application right after I filled it out and I had the insurance company fax me over a copy of when they recieved it. There is a 28 day difference from the time I handed in the packet til the insurance company got it. I have been in contact with the insurance company and they said they honor what my employer says for my enrollment date and the effective date.

They have to honor what the PLAN says, not what your employer says.
