Nursing Home Insurance vs Assisted LivingWhat is the name of your state (only U.S. law)? Illinois My elderly mother (90) has Nursing Home Insurance which she initially purchased over 30 years ago before they had even heard of Assisted Living. The insurance company will not pay for Assisted Living even though she fails two of their seven "triggers" because they say the policy is only for Nursing Home care. I have been told by a representative of an Assisted Living provider that there was legislation in 2002 which made it mandatory for insurance companies to provide payment for Assisted Living to policy holders of Nursing Home care due to the fact that there was no such product 30 years ago. I have tried to find this legislation to no avail. Can anyone provide me with the law (if it exists) or any other help in this situation.What is the name of your state (only U.S. law)? |

| Nursing home care is a higher level of care then assisted living. She will eventually (quite likely anyway) need this care, the policy will still pay for what it was designed to pay for. I have never heard of any such law. You should ask the person who told you this, what is the name of the law and whether it is state or federal. That would be a good start.
