Preexisting condition**************...


What is the name of your state (only U.S. law)? Utah
Can I get medical insurance on my own?
Tomorrow I will apply for a warehouse job close to my job. This job has stated on their help wanted ad on the Internet that they don't offer health insurance till after two years on the job. Now if I get offered a position with this company I am not so confident I would get medical insurance on my own.
I will tell you why.

Ever since 2003 I have had an on and off again battle with a medical eye condition called Uveitis. I had eye surgery in January 30 of 2008. I tried to get medical insurance on my own about 3 and 1/2 years ago. It got denied due to preexisting condition.

What should be my course of action?
Should I get an attorney? At least apply for medical insurance first and see what the outcome is? If I get denied again (which I like will) can I appeal the decision. I do hope that I have options available to me. Hope someone can help out.

An attorney can't do anything for you. Either you qualify or you don't. If you get denied at one company, look for another. Even if you get approved, your pre-existing condition will likely be excluded.

I'm tired and fading fast this evening, but I suggest looking at DOL regs RE prex cond as well as the group plan document. HIPAA portability and probably COBRA are also probably musts in this situation. The way I see it, you don't need a lawyer yet, you need be on the ball though. Uveitis shouldn't be a big to do. Not a hard question you pose except for the length of time till eligible for the group plan. Just not sure if that counts as a waiting period (I don't think so, not all anyway.) I just need to calculate your lookback period. I'll do that later if you don't mind after I get all the ducks in a row and post some more questions. lkc15507

If they don't offer the insurance for 2 years, I'm not sure where the lawyer/lawsuit comes in. Apply for individual health insurance. Some companies will simply exclude coverage for your pre-ex for a period of time, but you will still be able to get insurance.

Yes this would be an individual policy so no government regulations applying to GROUP policies would apply.
