Were My Hippa Rights Violated?


What is the name of your state? NJ

When I was Sixteen years old, I had Surgery for a neck injury. I should have been covered under my parents health insurance. at that time my mother took out a charity application in my name to cover some of the cost of the surgery that her insurance would not cover . 3 years later I was admitted to the same hospital and while i was there I explained to the hospital staff that i had just withdrawn from college, I was living with my mother but I was not covered under her insurance and that I would need information on obtaining charity care. Before being discharged from the hospital, I found out that the doctors and hospital staff spoke to my mother and not me about my financial obligations, my health and payment arrangements even though I admitted myself into this hospital. I never gave anyone any permission to speak to my mother. After being released a month later I started to receive bills in the mail totaling around $38,000. When i called to straighten the matter out, I was told that I was being billed for cost that my mothers insurance back in 2001 when i was sixteen had not covered and that I was also being billed for my 2005 visit in one lump sum. I made time to go to the charity care office and the secretary at the time told me that my mother had opened an application in my name on more than one occasion, and that I could not open a case in my own name. I Was 20 years old. I was legally already an adult. There should have been no reason why Applications were opened in my name without my consent. I can see that why when i was sixteen there would be a reason to open an application, but to deny me the right to an application? This just doesn't sound right to me at all and my lawyer has been really slow in handling this case. I just want to know if this was a HIPAA violation? I would appreciate any help with this matter.

HIPAA covers your medical information, not your financial information.

No, this is not a violation.

And it's HIPAA, not HIPPA.
