who is liable


What is the name of your state (only U.S. law)? pa but happened in ohio

i am writing on behalf of a ton of college kids.


college kids were attending the national championships in ohio and were exposed to carbon monoxide. apparently it was determined that the ice rink that the games were played in had faulty equipment and they had to shut down the ice rink. over 100 students/players were sent to hospitals for observation and oxygen. now the majority of all the insurance plans these kids have will not pay cause it was out-of-network. who is liable? would it be the ice rink (owners) of the kids/parents?

The rink is not liable unless there is evidence that they knew the equipment was dangerous and allowed the event to take place anyway.

If this was a medical emergency (which it sounds like it was), it shouldn't matter that it was out of area or out of network.

here is the odd part to the whole story. at approximately 5pm that night a child and a referee passed out. the fire company and police were called in and they evacuated everyone. cancelled 1 of the 2 schedueled games to be played later that night. well the top organization, the ACHA (american college hockey association) decided to play one of the games at 9:30pm that night. during the first period of the game, kids from both teams where having problems catching their breath and so forth.....so they stopped the game after the 1st period and evacuated the rink again. in the local news article it did state that they did not give the clearance or ok to re-open the ice rink till 2am that morning. i feel that the rink is liable as well as the ACHA since they decided to proceed with playing that one game and placing those kids at risk. it also indicated in the news article over 100 people were treated at local hospitals for this.

just a follow-up, this whole thing appeared on ESPN's show e-60. well i guess the rink is liable. i will send the bills there then!
