401K halted by employer

work for a co employement co. last december our 401k plan was switched to another financial co. (which is normal)
but due to the switch i have not been able to contribute for the past 6 months nor has my employer has not matched since then. i will be taxed at a higher rate next year because 401k is a pre tax deduction. co -employers are involved in dispute over this matter. how to gaurantee that myself and other employees will be compensated for missing oppurtunities over past 6 months to make contributions?
