58 year Old Layed off - but they kept younger/cheaper workers...

My father was layed off after working for a manafacturing company for nearly 4 years in Phoenix, he is 58 years old, 20+ years in field. The layoff was approx 60 people, no notice or severence was given. They retained younger people, who had less tenure, who made less money, have less job skills, and attendance problems in the same lab area, doing same work, with people he trained!!

Also posted on their website, is the same job he was doing for 2nd Shift. He would have gladly moved to 2nd Shift to stay working.

Owner of company begged him to stay 1 year ago for an additional 3.50/hr raise.

He had also discussed a problem with management about problem employee, problem employee turned out to be the boyfriend of the manager\director of HR and since then she has not treated him with any respect.

Additionally he has had perfect employment record, where he recieved all "4s and 5s" and was even told that they never give anyone 5s!!

He feels discriminated against, being 58 nearly 59, now who is going to hire him at that age, they wont tell it to his face, but he knows that most companies wont hire someone that close to retirement age....

He might be able to find work, but making 50% or less of what he was making, and not in his field.

Any input on this would be great...

Your father being laid off while less skilled and less senior employees were retained is not unlawful. No laws require employers to make wise choices when implementing a RIF. There may also be some business rationale that isn't apparent. Now of course if your father was selected for layoff because of his age, that's another matter.

In order to offer an opinion on whether age discrimination occurred, one would have to have fairly in-depth knowledge of who was laid off, what jobs they had, their ages, and the same for the people who were retained. If your father feels he was discriminated against because of his age, he should speak to an employment lawyer.
