What is the name of your state? ca

is it legal for a company to go to another state then ca to do a background check when thay can not do it legaly in calif

I'm just Joe b. Public (with an old dui) but I'm pretty sure background checks
by (CRA's) must follow the rules of the state of the individual. In other words because you are from CA. CRA's would have to obey by CA laws when reporting on you. It's not to say that they couldn't investigate you by other states guidlines, but they would be putting themselves at risk.

ps My understanding is if the Employer is doing the research themselves,
the rules do loosen up for the employer. Most privacy restrictions often relate to 3rd party companies that are hired to do the checks. Employers are given a little more leeway, especially if they suspect wrong doing.

I am very interested/concerned about simular related issues, I have a customer from Bettonville AR. who may do background checks on suppliers. I informed my HR about a DUI, but know one else knows in my company, and I am fearful that this customer may inadvertenly destroy my career.

Any additional insight would be appreciated.
