My husband was transferred from another state to temporarily (one to two years) work in Cal. His company is taking state taxes from his salary but told him that they would not take state taxes from his per diem (living expenses) until after he had been working in the state for one year. He has been in the state since May of this year. His last paycheck reflected a deduction for all back state taxes on his per diem since May. What are the Cal. tax laws regarding taxing per diem? Is there a year's deference in paying state taxes on per diem as the company lead him to believe? Is it "legal" for the company to take per diem taxes out of his salary instead of the actual per diem? Any information on this subject is greatly appreciated!
