These ppl are jerks. Today when my husband got his final check from them he was not paid for New Years Day. When he called the office and talked to the receptionist she said she would have to pull his file and talk to the boss...(she is the one who does all their payroll) and she couldn't do anything about it until tomorrow or Wednesday. Now the only requirements for getting holiday pay after your 8 week probationary period is that you work the day before the holiday and the day after..which he did. So my question is this...If he goes and cashes the check does that make it impossible for us to collect on the other day they owe him? Maybe by saying since we cashed the check we were in agreement to the hours worked and the pay...or does it work that way with payroll? I appreciate any advice you could give me. Thanks so much.

Signing the check does not in any way stop you from pursing the issue of the unpaid holiday. Unless they have put something on the back of the check indicating that endorsement signifies agreement that all wages earned have been paid, and sometimes even then, you may continue to pursue any monies you believe are due.

However, you should be aware that employers legally are not required to pay ANY holidays to ANY employee. The way you have described these people, I wouldn't be surprised to have them pull out a policy saying that no holiday pay is available once an employee has given notice - I know some companies that do that. And unless you were prepared to prove that all other employees had been given holiday pay after giving notice and that this policy had been written specifically to avoid paying your husband for New Year's Day, it would probably be legal.

If they fail to follow through with the holiday pay, I would encourage you to talk to the Missouri DOL.

Again, thanks. Sometimes on this board you get a lot more than you bargained for (rudeness,judgements,etc.) you are very professional and objective. Certain people could take a lesson.

I know exactly WHO you are talking about. I've never seen anyone else get so much enjoyment out of kicking people when they are already down. Although I did see that this person had sent a half-cordial response to someone else so maybe this person realizes not everyone is as perfect as he/she is.

I, too, feel that cbg gives not only honest and accurate advice, but sometimes can be encouraging. So thanks again, cbg!!
